Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
iNHouse Communications is uniquely positioned to deliver the service required by Hyde due to the close working relationship that the Chair and Managing Director have with the current Government. No other service provider can offer the level of access within Government circles that these individuals can. The support services they offer are unique and they have an unparalleled track record within the sector.
Hyde’s assessment is that iNHouse Communications is singularly placed to not only design the service but also to execute it in practice. The founding partners provide unique access to senior decision makers, the workings of this Government, and skills to assist Hyde in delivering its objectives.
Hyde is therefore of the view that if it were to seek to procure the Contract in accordance with the Regulations, competition would be absent for technical reasons as no service provider in the market would be able to provide the unique access to policy makers that iNHouse can.
